  Course Description

  Chiropractors will be briefed on the many recent legislative changes and potential impacts to their practices on both the state and federal level.  Disciplinary pitfalls are also highlighted, along with strategies to steer clear of them. Attendees will have their recollections refreshed on the regulations surrounding advertisement requirements.

  We will discuss the updates on auto insurers clawing back PIP benefits across the state of Florida.  

  Attendees will learn about the court decisions that impact how chiropractors bill for and use manual therapy and shockwave therapy and the red flags to watch out for.  Attendees will also learn the legal requirements for serving as an expert witness and what lawyers want out of deposition testimony to fulfill their legal obligations in their cases.

  Learning Objectives

  1. Identify recent state and federal legislative changes impacting the profession, and potential implications for chiropractors including the new EKG law, the MOBILE Act, and fingerprinting requirements.
  2. Review of the top laws and regulations affecting Florida chiropractors and practice owners, such as permissible advertising content and sexual misconduct in the workplace.
  3. Review the status of PIP clawbacks and how to avoid getting targeted.
  4. Review case law interpretation of manual therapy by unlicensed chiropractic assistants and the use of shockwave therapy in your practice regarding PIP.
  5. Understand the legal requirements of becoming an expert and deposition techniques to help you fulfill those requirements.

  Kimberly A. Driggers-Jaffe is the owner of Driggers Law, PA, where she represents the Florida Chiropractic Association as its General Counsel and serves as one of its Lobbyists.  For the prior twenty-plus years, Ms. Driggers was in private practice in Orlando and Tallahassee, Florida, initially representing the interests of insurance companies in their defense of injury and insurance claims.  After many years and for the majority of her practice, she put her insurance knowledge to use in representing medical providers, injured patients, and homeowners in the denial of insurance benefits and litigating insurance claims in courts throughout Florida.

  Kim is well known in the area of Personal Injury Protection insurance law (No-Fault or PIP insurance) and has authored numerous articles, testifies regularly in the Florida Legislature, and lectures for the Florida Chiropractic Association throughout the State of Florida.  She is a longstanding member of the National Association of Chiropractic Attorneys.

  In August 2019, Ms. Driggers became the first Non-Chiropractor and the seventh woman since 1963 to be elected to the National Board of Chiropractic Examiners, the international testing agency for the chiropractic profession that develops, administers, and scores standardized exams for the chiropractic profession.

  She received her B.A. in Psychology Magna Cum Laude from Rollins College in Winter Park, Florida, in 1990.  Ms. Driggers attended the Florida State University College of Law, receiving her J.D. in 1994.
