    Scott Kirschbaum Esq.

    Scott Kirschbaum, Esq., is a Senior Partner and co-chair of the Nursing Home and Adult Living Facilities practice group with more than thirty-three years of experience defending medical professionals, hospitals, long-term care facilities, and other healthcare providers in complex litigation matters. His practice focuses on wrongful death, catastrophic injury, medical malpractice, nursing home and assisted living negligence, group home and treatment facility claims, including defending negligence claims against chiropractors, acupuncturists, aestheticians, and licensed massage therapists. Scott has tried more than forty-three jury trials, handled numerous bench trials and arbitrations, and has argued appeals before Florida’s Third and Fourth District Courts of Appeal. In addition to his litigation practice, he represents healthcare professionals in licensure and disciplinary matters before the Florida Department of Health, AHCA, and DCF. He has provided his insurance industry clients with coverage counseling and has pursued coverage declaratory actions on their behalf.

    Chiropractors will be briefed on the many recent legislative changes and potential impacts to their practices on both the state and federal level.  A Board of Chiropractic Medicine Declaratory Order will also be highlighted.  Attendees will be updated on the current case law that applies to their practices.  

    Surprise PIP investigations happen regularly in Florida.  Chiropractors will see a PIP office investigation first-hand and will be educated on the laws surrounding PIP investigations and will receive counsel on how to best handle the PIP investigator when he/she arrives at the office.

    PIP clawbacks are still occurring in Florida, impacting many doctors who treat accident victims.  This segment will show doctors an example of an actual PIP clawback meeting.  Doctors will receive counsel as to the red flags involved for PIP clawbacks and how to best avoid being targeted for a clawback.

    Chiropractic malpractice claims and allegations, while occurring at a much lower level than medical malpractice claims, still hits chiropractic offices across the state.  Here you will see a chiropractic malpractice claim from A to Z and attendees will learn how to best prevent a claim from happening and what to do should one occur.

    Kim Jaffe Esq.

    Kimberly A. Driggers-Jaffe is the owner of Driggers Law, PA, where she represents the Florida Chiropractic Association as its General Counsel and serves as one of its Lobbyists.  For the prior twenty-plus years, Ms. Driggers was in private practice in Orlando and Tallahassee, Florida, initially representing the interests of insurance companies in their defense of injury and insurance claims.  After many years and for the majority of her practice, she put her insurance knowledge to use in representing medical providers, injured patients, and homeowners in the denial of insurance benefits and litigating insurance claims in courts throughout Florida.

    Kim is well known in the area of Personal Injury Protection insurance law (No-Fault or PIP insurance) and has authored numerous articles, testifies regularly in the Florida Legislature, and lectures for the Florida Chiropractic Association throughout the State of Florida.  She is a longstanding member of the National Association of Chiropractic Attorneys.

    In August 2019, Ms. Driggers became the first Non-Chiropractor and the seventh woman since 1963 to be elected to the National Board of Chiropractic Examiners, the international testing agency for the chiropractic profession that develops, administers, and scores standardized exams for the chiropractic profession.

    She received her B.A. in Psychology, Magna Cum Laude, from Rollins College in Winter Park, Florida, in 1990.  Ms. Driggers attended the Florida State University College of Law, receiving her J.D. in 1994.
